These Terms of Service ("Terms") are a legal agreement between you and XBoson, Inc. ("MedBos," "we," "us," or "our") governing your access to and use of the MedBos™ platform, websites, and services (the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for the accuracy of your account information and for keeping your credentials confidential. You are responsible for activity that occurs under your account. Notify us promptly of any unauthorized use.
MedBos provides pharmacy and medication analytics that help members and their health plans understand medications, safety considerations, and costs. Features may change over time. We may add, modify, or discontinue features, and we may set limits on use to protect the Services.
If you choose to connect your Medicare account, you authorize MedBos to retrieve your Medicare claims information through the CMS Blue Button 2.0 program, subject to the consent you grant on CMS's systems. You represent that the Medicare account you connect is your own. You may disconnect and revoke access at any time as described in our Privacy Policy. Your use of Medicare data is also subject to CMS's terms and to Medicare.gov.

The Services, including software, text, and design, are owned by XBoson, Inc. and its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services as permitted by these Terms. You retain your rights in data you provide; you grant us the rights needed to operate the Services and deliver features to you.
The Services may interoperate with third parties, including CMS Blue Button 2.0. We are not responsible for third-party services, and your use of them is governed by their own terms.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or that information will be complete or accurate.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDBOS AND XBOSON, INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless MedBos, XBoson, Inc., and our affiliates from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Services or violation of these Terms, to the extent permitted by law.
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or to protect the Services. Provisions that by their nature should survive termination will survive.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except where applicable law requires otherwise. Disputes will be resolved in the state or federal courts located in Delaware, unless applicable law provides otherwise.
